Orchestra production is cheap these days :)
A producer normally has bought his own orchestral libraries. They are professional recorded from orchestras and studios all over the world (for example the Los Angeles Scoring Strings), and if you have bought their license you can use them for your music without any right issues.
The producer would use those (which he has already bought anyway), and with this model their won't remain any rights on the instruments. The only right which would remain is that of the producer on his audio file, and this would be what we would buy from him.
If you were thinking of a real orchestra (not with those plugins and not with a producer): This is something which costs around 5000-15000 per recording day. That is something even most TV-Shows won't have in their production budget. Only really big projects (like for the cinema) do this. If OC conquers the world tomorrow, alright we can think about that again :).
